CALL TO ORDER

Vice Chairman Hurt called the June 28, 2016 Planning and Zoning Commission Special Session to order at 6:01 PM.

PLEDGE OF ALLEGIANCE

Vice Chair Hurt led the audience and the Commission in the Pledge of Allegiance.

CALL TO AUDIENCE - at this time, any member of the public is allowed to address the commission on any issue not listed on today’s agenda.  Pursuant to the Arizona open meeting law, individual commission members may ask town staff to review the matter, ask that the matter be placed on a future agenda, or respond to criticism made by speakers.  However, the commission may not discuss or take legal action on matters raised during "call to audience."  In order to speak during "call to audience" please specify what you wish to discuss when completing the blue speaker card.

Robert Kirschman provided a presentation that included the following:

- Purpose
- Location Map
- Conditional Use Permit Review Criteria
- Traffic/Circulation
- Neighborhood Meeting/Public Input
- Recommendation

Commissioner Barrett asked staff to summarize where care will be routed when coming in from Steam Pump Ranch.

David Law, Permitting Manager responded that the preferred route was worked out with Basis School, developer, Oro Valley Police Department, fire department in addition to the engineering staff.  The duel left turn project was a direct result of the school going into the site along with the expansion of the school.  The entrance into the center along Steam Pump Way was reconfigured, the turn into the Quiktrip has been closed off that allows additional traffic to go straight into the intersection.  Basis School will provide a map to the parent and will be encouraged to follow, there is also opportunities to utilize other lanes.

Commissioner Swope commented that no documentation was provided to reflex any input what so ever from Basis School.  The Commission doesn't really know the position of the school.

Mr. Kirschmann responded that staff met with Basis representatives with discussion that revolved around the project.  Basis representative made it very clear they wanted to keep the circulation as close as possible to what they have out there today.  Basis representative were in agreement with the straight alignment of the road that was proposed to you today.

Chad Daines, Principal Planner, responded that the Basis provided a written signature acknowledging the circulation plan and accepting the plan.

Matt Stuart, Cypress civil development, representing the developer, provided a presentation that included the following:

- Conceptual Site Plan
- Conceptual Landscape Plan
- Traffic Analysis Revised Table
- Estimated Maximum Queue by start times for all grades
- Estimated Maximum Queue by Exit Times for all grades
- Basis Oro Valley Circulation Study - Preferred Route

Vice Chair Hurt opened the public hearing.

Diane Bristow, Oro Valley resident, commented that she has attended both neighborhood meetings and the concern was traffic.  The developer has the right to build a Freddy's restaurant but does not have a right to have a drive-thru.  A conditional use permit for Freddy's would be unsafe.

Vice Chair Hurt closed the public hearing.

Vice Chair Hurt questioned the staff about the meeting that was held to help figure out the best traffic plan, who was there and what conclusion were made. 

Mr. Kirschmann responded that Town Planning Division, Town engineers, Oro Valley police, fire department, applicant, applicant engineers, representative from Basis school and the overall developer for the site were in attendance.  The plan that is being proposed was discussed.

Mr. Laws commented that a couple of different options were discussed as well, but came back to the plan that is proposed tonight.  The circulation plan being proposed tonight was the plan that was supported by all that were in attendance at the meeting.

MOTION: A motion was made by Commissioner Gribb recommend conditional approval based on the finding that the request is in conformance with the Conditional Use Permit review criteria.

Motion died for lack of a second. 

MOTION: A motion was made by Commissioner Swope and seconded by Commissioner Barrett continue this item until the next meeting and ask staff and the applicant to be more specific in terms of pedestrian circulation and conflict points.

Ricky Lyons, Developer, provided an overview on the drive-thru and included the following:

- Drive-thru is a particular part of the plan
- The longest drive-thru he has been associated with

Commission Drzazgowski excused himself from the meeting at 7:05 pm.

Vote to continue this item until the next meeting and ask staff and the applicant to be more specific in terms of pedestrian circulation and conflict points. (Failed for lack of majority)

Commissioner Swope - Yes
Vice Chair Hurt - Abstain

MOTION: A motion was made by Commissioner Gribb and seconded by Commissioner Swope recommend conditional approval based on the finding that the request is in conformance with the Conditional Use Permit review criteria.

Commissioner Swope offered a friendly amendment to the motion that included additional analysis go into the pedestrian circulation to and from Basis along the conflict points, one on the main drive and entrance to Freddy's. 
Friendly amendment was accepted by Commissioner Gribb, maker of the motion.

MOTION carried, 3-1 with Commissioner Barrett opposed.

MOTION: A motion was made by Commissioner Swope and seconded by Commissioner Barrett to adjourn the Planning and Zoning Commission Special Session meeting at 7:46 PM.
