MINUTES ORO VALLEY BOARD OF ADJUSTMENT REGULAR SESSION December 14, 2021 ORO VALLEY COUNCIL CHAMBERS 11000 N. LA CAÑADA DRIVE

SPECIAL SESSION AT OR AFTER 3:00 PM

CALL TO ORDER

Chair Dankwerth called the meeting to order at 3:00 p.m.

Staff Present:	Milini Simms, Principal Planner
	Joe Andrews, Chief Civil Deputy Attorney
Attendees:	Steve Solomon, Town Council Liaison

PLEDGE OF ALLEGIANCE

Chair Dankwerth led the Board and audience in the Pledge of Allegiance.

CALL TO AUDIENCE

There were no speaker requests.

COUNCIL LIAISON COMMENTS

Council Liaison Steve Solomon stated that the Town Council recently approved the recording/video of all board and commission meetings held in the Council Chambers. He also thanked the Board for their service.

SPECIAL SESSION AGENDA

REVIEW AND APPROVAL OF THE SEPTEMBER 28, 2021 REGULAR SESSION MEETING MINUTES


				Motion by Vice Chair Stephen Roach, seconded by Member Mary Murphy to approve the September 28, 2021 regular session meeting minutes.

				Vote: 3 - 0 Carried

	2.			PUBLIC HEARING: DISCUSSION AND POSSIBLE ACTION REGARDING A VARIANCE REQUEST TO REDUCE THE REAR YARD SETBACK FROM 40 FEET TO 14.5 FEET FOR A HOUSE ADDITION AT 1241 W. LINDA VISTA BLVD, CASE NUMBER 2102481
				Senior Planning Technician Patty Hayes provided a presentation that included the following: - Purpose - Location - Applicant's request - Five Findings - Special circumstances: property size, shape, topography, existing building location - Special circumstances not created by previous or current owner - "Preservation of privileges", while not granting special privileges - Authorizing variance not materially detrimental to neighbors - Summary and recommendation The applicants provided a presentation that included the following: - Photo of proposed finished home - Chronology - Different considered plans/layouts - Summary Chair Dankwerth opened the public hearing. There were no speaker requests. Chair Dankwerth closed the public hearing. Discussion ensued among the Board, applicants and staff.


				Motion by Vice Chair Stephen Roach, seconded by Member Mary Murphy to approve this variance request to reduce the rear yard setback from 40 feet to 14.5 feet for the proposed addition at 1241 W. Linda Vista Blvd., based on the finding that the five criteria have been met.

				Vote: 3 - 0 Carried

ADJOURNMENT Chair Dankwerth thanked Member Murphy for her service and adjourned the meeting at 3:22 p.m.
