REGULAR SESSION AT OR AFTER 6:00 PM
             
CALL TO ORDER
  Mayor Winfield called the meeting to order at 6:00 p.m.

  Mayor Winfield led the audience in the Pledge of Allegiance. 
             
UPCOMING MEETING ANNOUNCEMENTS
  Town Clerk Mike Standish announced the upcoming Town meetings. 
             
MAYOR AND COUNCIL REPORTS ON CURRENT EVENTS
  Councilmember Jones-Ivey recognized Grayson Golder, a fifth grader at Painted Sky Elementary School, for his academic excellence and community support.

Councilmember Greene reported that he and Mayor Winfield attended the Patriot's Day event at the Lehman Academy of Excellence School held on September 12, 2022. 

Councilmember Greene reported that the tennis/pickleball courts at the Community and Recreation Center had been painted and was hopeful that they would be ready for use sometime in October.
             
TOWN MANAGER'S REPORT ON CURRENT EVENTS
  Town Manager Mary Jacobs reported the following:
 
  • Congratulated the Oro Valley Police Department for their recent Arizona Law Enforcement Accredation Award.
  • The Town of Oro Valley had been awarded 3.7 million dollars from the Pima Association of Governments for a multi-use path on Naranja Drive from 1st Avenue to La Canada Drive.
  • Congratulated staff and the Gordley Group for receiving a National Award from the City-County Communications & Marketing Association for their work on the OVSafeSteps program.
             
ORDER OF BUSINESS
  Mayor Winfield reviewed the order of business and stated that the order would stand as posted.

  There were no informational items.
             
CALL TO AUDIENCE
  Oro Valley resident Vicky Tarris voiced her concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request.

Oro Valley resident  Anthony Ferrara voiced his concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request. 

Oro Valley resident Karen Steinbroun voiced her concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request. 

Oro Valley resident Tim Fagan voiced his concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request. 

Oro Valley resident Tim Tarris voiced his concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request. 
             
PRESENTATIONS
             
   1. Proclamation - Diaper Need Awareness Week
  Mayor Winfield proclaimed the week of September 24 through October 2, 2022 as Diaper Need Awareness Week in Oro Valley.

Dr. Shannon Roberts, CEO of the Diaperbank of Southern Arizona, accepted the proclamation.
             
   2. Recognition of Golder Ranch Fire Chief Randy Karrer on his induction into the Arizona Fire Service Hall of Fame
  Mayor Winfield recognized Golder Ranch Fire Chief Randy Karrer for his induction into the Arizona Fire Service Hall of Fame and for receiving the 2022 Weber Lifetime Achievement Award. 

Fire Chief Randy Karrer expressed his gratitude for the recognition.   
             
   3. Presentation and possible discussion of the Town's FY 21/22 Financial Update through June 2022
  Deputy Finance Director Wendy Gomez presented the Town's Fiscal Year 21/22 Financial Update through June 2022 and included the following:
 
  • General Fund Revenues
  • General Fund Expenditures
  • General Fund
  • Highway Fund Revenues
  • Highway Fund Expenditures
  • Highway Fund
  • Community Center Fund Revenues
  • Community Center Fund Expenditures
  • Community Center Fund

Discussion ensued amongst Council and staff regarding item #3.
             
CONSENT AGENDA
  Councilmember Bohen and Councilmeber Jones-Ivey requested that Consent item (B) be removed from the Consent Agenda for discussion.  
             
   A. Minutes - September 7, 2022
             
   C. Approval to ratify the Mayor's reappointment request of a citizen member to the Corrections Officers Retirement Plan (CORP) Local Board
             
  Motion by Mayor Joseph C. Winfield, seconded by Councilmember Josh Nicolson to approve Consent items (A) and (C). 

  Vote: 7 - 0 Carried
             
   B. Resolution No. (R)22-39, approving a loan agreement between the General Fund and Water Fund
  Councilmember Bohen voiced his concerns regarding item (B).

Councilmember Jones-Ivey voiced her concerns regarding item (B). 

Discussion ensued amongst Council and staff regarding item (B).

Town Manager Mary Jacobs provided clarification of item (B). 

Discussion continued amongst Council and staff regarding item (B). 
             
  Motion by Mayor Joseph C. Winfield, seconded by Councilmember Steve Solomon to bring this item back for discussion at a future Council meeting.

  Vote: 7 - 0 Carried

  Mayor Winfield adjourned the Regular Session at 7:34 p.m.

  Mayor Winfield called the Study Session to order at 7:35 p.m.
             
STUDY SESSION AGENDA
             
   1. PRESENTATION AND POSSIBLE DISCUSSION OF SCOPE OF WORK FOR PLANNED HOUSING STUDY PER THE TOWN COUNCIL'S FY 21/22 - FY 22/23 STRATEGIC LEADERSHIP PLAN
  Principal Planner Milini Simms presented the proposed scope of work for the Planned Housing Study and included the following:
 
  • Purpose and Timing
  • Process for Developing the Housing Study Scope
  • Proposed Scope
  • Timeline and Next Steps
  • Response to Commission and Council Feedback
  • Summary and Next Steps

Discussion ensued amongst Council and staff regarding Study Session item #1. 
             
ADJOURNMENT OF THE STUDY SESSION
  Mayor Winfield adjourned the Study Session at 8:28 p.m.
             
RECONVENE THE REGULAR SESSION
  Mayor Winfield reconvened the Regular Session at 8:28 p.m.
             
EXECUTIVE SESSION 1. Pursuant to A.R.S. §38-431.03(A)(4) for settlement discussions regarding Marsh v. Oro Valley claim

2. Pursuant to A.R.S. §38-431.03(A)(1) and (A)(3) Personnel matter - Town Manager's annual performance review
             
  Motion by Mayor Joseph C. Winfield, seconded by Councilmember Joyce Jones-Ivey to go into the Executive Session at 8:29 p.m., 1. Pursuant to A.R.S. §38-431.03(A)(4) for settlement discussions regarding Marsh v. Oro Valley claim 2. Pursuant to A.R.S. §38-431.03(A)(1) and (A)(3) Personnel matter - Town Manager's annual performance review.
 

  Vote: 7 - 0 Carried
  Mayor Winfield announced that the following staff would be joining Council in the first Executive Session: Town Manager Mary Jacobs, Town  Attorney Jonathan Rothschild, Legal Services Director Tobin Sidles, and Town Clerk Mike Standish.

Mayor Winfield announced that the following staff would be joining Council in the second Executive Session: Town Manager Mary Jacobs, Town Attorney Jonathan Rothschild, and Town Clerk Mike Standish.
             
RESUME THE REGULAR SESSION
  Mayor Winfield resumed the Regular Session at 10:22 p.m.
             
REGULAR AGENDA
             
   1. FOR DIRECTION TO THE TOWN MANAGER AND/OR NECESSARY STAFF AS DISCUSSED IN EXECUTIVE SESSION,TO APPROVE OR DENY A SETTLEMENT OF MARSH V. ORO VALLEY CLAIM
             
  Motion by Mayor Joseph C. Winfield, seconded by Councilmember Steve Solomon to approve the settlement of the Marsh v. Oro Valley claim in the amount of $37,500.00.

  Vote: 7 - 0 Carried
             
   2. FOR DIRECTION TO THE TOWN ATTORNEY AND/OR NECESSARY STAFF AS DISCUSSED IN EXECUTIVE SESSION REGARDING THE TOWN MANAGER'S ANNUAL PERFORMANCE REVIEW
             
  Motion by Mayor Joseph C. Winfield, seconded by Councilmember Josh Nicolson to proceed as directed in Executive Session.

  Vote: 7 - 0 Carried
