CALL TO ORDER
  Mayor Winfield called the meeting to order at 6:01 p.m.

  Mayor Winfield led the audience in the Pledge of Allegiance. 
             
UPCOMING MEETING ANNOUNCEMENTS
  Town Clerk Mike Standish announced the upcoming Town meetings. 
             
MAYOR AND COUNCIL REPORTS ON CURRENT EVENT
  Councilmember Jones-Ivey recognized Wyatt Vroom, a fifth grader at Leman Academy, for his academic excellence and community support.

Councilmember Greene highlighted the following events that he had participated in: Sun City Oro Valley's reopening of their Activity Center and an archeology event at the Oro Valley Public Library. Councilmember Greene also encouraged residents to get their tickets for the Oro Valley Theater Company's upcoming performance, The Sunshine Boys, performed on February 17, 18 and 19, 2023.

Councilmember Jones-Ivey reported that Canyon Del Oro Project Graduation was still in need of volunteers and donations. She encouraged interested citizens to email cdo.pg.decortions@gmail.com. 

Councilmember Bohen was pleased to find out that a local cardiology office had recently moved their business into an existing space at the Oro Valley Market Place. 
             
TOWN MANAGER'S REPORT ON CURRENT EVENTS
  Interim Town Manager Chris Cornelison recognized Oro Valley Public Works staff for their recent Cartegraph Flag Forward Award, received for the overhaul of the Town's Adopt-A-Road/Trail program and website. Mr. Cornelison also recognized and thanked the outgoing General Manager of Indigo Golf, Mr. Bernie Eaton.

  Mayor Winfield reviewed the order of business and stated the order would stand as posted. 
             
INFORMATIONAL ITEMS
  There were no informational items. 
             
CALL TO AUDIENCE
  Bernie Eaton of Indigo Golf thanked Council and staff for a terrific working partnership. Mr. Eaton also provided an overview of the success of the El Conquistador Golf Course and publicly thanked his team for their leadership and tireless work ethic. 

Oro Valley resident Valerie Steinbronn voiced her concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request.

Oro Valley resident Debbie Patrick voiced her concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request.

Oro Valley resident Doug Dalby voiced his concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request.

Oro Valley resident David Deivert voiced his concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request. 

Oro Valley resident Darlene M. Backken spoke on behalf of Rosemary Gordon Panuco. Ms. Backan voiced the concerns of Ms. Gordon Panuco regarding the proposed Oro Valley Church of the Nazarene rezoning request.

Oro Valley resident Tim Tarris voiced his concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request. 

Oro Valley resident Joanne Michaelsen voiced her concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request. 

Oro Valley resident Anthony Ferrara voiced his concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request. 

Oro Valley resident and President of Friends of Push Ridge Golf, Tony D'Angelo, spoke regarding the Pusch Ridge Golf Course and the various golf initiatives that had been done by the Friends of Push Ridge Golf.

Oro Valley resident Elizabeth Robb voiced her concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request. 

Sheila Lepley voiced her concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request. 

Oro Valley resident Devin Smith voiced her concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request. 

Liam DeDeppo voiced his concerns regarding the proposed Oro Valley Church of the Nazarene rezoning request.
             
PRESENTATIONS
             
   1. Presentation and possible discussion of the Town's Annual Comprehensive Financial Report and Single Audit for Fiscal Year ending June 30, 2022
  Chief Financial Officer Dave Gephart provided a brief overview of the Town's Annual Comprehensive Financial Report and Single Audit for Fiscal Year ending June 30, 2022. Mr. Gephart introduced Mr. Brian Hemmerle from Baker Tilly LLP. 

Mr. Hemmerle presented Presentation item #1 and included the following:
 
  • Required Communications with Town Council and Management
  • Findings and Recommendations
  • Financial Highlights
  • Total Government Wide
  • Fund Balance - Governmental
  • Fund Balance - Enterprise Funds
  • Fund Balance

Discussion ensued amongst Council, staff, and Mr. Hemmerle regarding Presentation item #1. 
             
CONSENT AGENDA
             
   A. Minutes - January 4, 2023
             
   B. Appointment to the Stormwater Utility Commission (SWUC)
             
  Motion by Councilmember Steve Solomon, seconded by Councilmember Josh Nicolson to approve Consent items (A) and (B).

  Vote: 7 - 0 Carried
             
REGULAR AGENDA
             
   1. PUBLIC HEARING: DISCUSSION AND POSSIBLE ACTION REGARDING AN APPLICATION FOR A SERIES 11 (HOTEL/MOTEL) LIQUOR LICENSE FOR WESTWARD LOOK GRAND RESORT & SPA, LOCATED AT 245 E. INA ROAD
  Town Clerk Mike Standish presented item #1.

Mayor Winfield opened the public hearing.

Mayor Winfield closed the public hearing.
             
  Motion by Councilmember Harry Greene, seconded by Councilmember Josh Nicolson to recommend approval of the issuance of a Series 11 Liquor License to the Arizona Department of Liquor Licenses and Control for Lauren Kay Merrett for Westward Look Grand Resort & Spa, located at 245 E. Ina Road.

  Vote: 7 - 0 Carried
             
   2. DISCUSSION AND POSSIBLE DIRECTION FOR UTILIZING $5.4 MILLION IN RESTRICTED ARPA FUNDS
  Chief Financial Officer Dave Gephart gave a brief overview of item #2. 
             
  Motion by Vice-Mayor Melanie Barrett, seconded by Councilmember Josh Nicolson to direct staff to allocate ARPA funding to already budgeted items including eligible capital improvement projects, town partnerships with eligible entities and eligible employee pay as town staff shall find reasonably practicable to report and administer. Any remaining funds shall be allocated as part of the upcoming budget.

Discussion ensued amongst Council and staff regarding item #2. 

Vice Mayor Barrett requested an amendment to the main motion, seconded by Councilmember Nicolson, to direct staff to allocate ARPA funding to already budgeted items, including eligible capital improvement projects.

             
  Motion by Vice-Mayor Melanie Barrett, seconded by Councilmember Josh Nicolson FINAL MOTION AS AMENDED to direct staff to allocate ARPA funding to already budgeted items, including eligible capital improvement projects.

  Vote: 6 - 1 Carried

   3. RESOLUTION NO. (R)23-03, DISCUSSION AND POSSIBLE ACTION TO ESTABLISH THE ORO VALLEY HEALTH CARE BENEFITS TRUST FOR THE TOWN SELF-INSURANCE PROGRAM
  Chief Financial Officer Dave Gephart provided a brief overview of item #3.

Discussion ensued amongst Council and staff regarding item #3.
             
  Motion by Vice-Mayor Melanie Barrett, seconded by Councilmember Josh Nicolson to approve Resolution No. (R)23-03, establishing the Oro Valley Health Care Benefits Trust for the Town's Self-Insurance Program; and authorizing the Mayor, Town Clerk, and Town Legal Services Director to execute the trust document to carry out the purposes and intent of this resolution.

  Vote: 7 - 0 Carried

  Motion by Mayor Joseph C. Winfield, seconded by Councilmember Harry Greene to adjourn the meeting at 7:49 p.m.
