CALL TO ORDER

MINUTES   Approval of the Minutes of August 26, 2008

MOTION: A motion was made by Member Hickey and seconded by Member Fields to approve the minutes of the August 26, 2008 meeting.

MOTION carried, 4-0.

CASE NO:  OV10-08-09, Dino Maniquis and Esperanza Montesclaros request a variance from the required 40’ rear yard setback to 22’.  Subject (parcel #224-27-1690) located at 10922 N. Poinsettia Drive, Oro Valley, AZ, 85737.


Chair Parisi swore in the applicant Dino Maniquis and contractor Harry Terry.

Mr. Maniquis requested a variance to build a garage. He noted that his home was built in 1987 prior to annexation into Oro Valley.

Vice Chair Swope questioned whether the garage could be placed on the opposite side of the house.

Mr. Terry stated that it would add an additional cost of $50,000 - $60,000 for the driveway to be extended and cut across the front of the house.

It was noted that the air conditioning unit would be moved behind the garage. Zoning Inspector Patty Hayes stated that mechanical equipment was exempt from setback requirements.

Ms. Hayes presented the Staff report. She reported that:
~was for a garage to encroach 18 feet into the required 40 foot setback
~reduce the rear yard setback to 22 feet.
~a notice of this hearing was posted on the property and online
~property owners within 300 feet of the property were notified by mail
~The applicant submitted 5 letters of approval from neighbors.
~2 adjacent neighbors came to review the plans and expressed concerns regarding drainage and retaining walls.
~The house was built in 1987 under the jurisdiction of Pima County
~The proposal would:
  *utilize the existing driveway 
  *comply with the 20 foot side yard setback and the 18 foot maximum building height.

Chair Parisi opened the public hearing at 3:10 p.m. There being no speakers, he closed the hearing.

Member Hickey stated that all criteria were met. He noted that though technically feasible, it was not reasonable to move the garage to the south side of the property.

Vice Chair Swope stated that he had some hesitation regarding the retaining wall and the required fill and drainage but noted that these issues will be addressed during the building and grading.

Chair Parisi stated that the criteria had been met due to topography and that the request was consistent with the neighborhood.
