CALL TO ORDER AT OR AFTER 3:00 PM

Chair Adler called the Board of Adjustment Regular Session to order at 3:00 pm.

REVIEW AND/OR APPROVAL OF THE JULY 28, 2015 REGULAR SESSION MEETING MINUTES

MOTION: A motion was made by Vice Chair Dankworth and seconded by Member Bohl to approve

DISCUSSION AND POSSIBLE ACTION ON REQUEST FOR A VARIANCE FOR 830 EAST PALISADES ROAD TO ALLOW A DETACHED GARAGE TO BE CONSTRUCTED CLOSER TO THE FRONT LOT LINE THAN THE HOME, OV1501314

Robert Kirschman, planner, presented a staff report which included the following: 
~Purpose of the application
~Existing site conditions
~Variance criteria
~Alternative building locations
~Summary

The property Owners, Francine Trotter and Brandon Trubee, provided a PowerPoint presentation on why they need a detached garage in the front yard. The presentation covered the variance criteria and their reasons for approval.

MOTION: A motion was made by Member Roach to deny

MOTION: A motion was made by Vice Chair Dankworth and seconded by Member Bohl to approve

MOTION carried, 4-1 with Member Roach opposed.

UPDATE AND DISCUSSION REGARDING THE LEGAL TERMS "STANDING AND "AGGRIEVED" AND RECENT LEGISLATIVE CHANGES PERTAINING TO APPEALS OF DECISIONS


Joe Andrews, Chief Civil Deputy Attorney, reviewed the changes and provided clarification regarding HB 2525.

DISCUSSION REGARDING SITE TOURS AND EX PARTE CONTACTS


Joe Andrews reviewed the definition of "ex parte", and stated the members of the Board cannot speak with an applicant regarding the variance while on site visits.

FUTURE AGENDA ITEMS

PLANNING UPDATE (INFORMATIONAL ONLY)
Rosevelt Arellano, Senior Planner, provided the following updates:

~December 2nd Town Council will hear Stone Canyon Casitas Conceptual Site Plan & Conceptual Architecture

~Town Council will be on Holiday break through January 6th, 2016

~The Board of Adjustment will have a Special Session meeting on Monday, December 14th to hear a height Variance for 642 Windy Peak Height Variance

~There are no neighborhood meetings scheduled at this time
