*1. Discussion and possible action on a request for a variance at 9450 N. Raleigh Place to allow a detached garage to be built closer to the front lot line than the main house, OV1700049. *(ITEM WITHDRAWN BY APPLICANT AND WILL NOT BE HEARD)
Patty Hayes, Senior Planning Technician, presented on the following:

- Summary
Peter Zorilla, Tamarron Homes, representing applicant, stated design is to minimize damage to property. When septic tank was located, had to move the proposed building further away from house. A current metal building on property will be removed during this process. The HOA has already given approval for this structure as well as adjacent homeowners. Staff has denied variance request based on not meeting one of five criteria. Grading issues present issues of building the garage structure in the back.
Questions/issues raised by Board:
- What is the cost of new septic system?
- Why is the top of the building 5 feet, 2 inches higher than the garage door?
- What if garage had a different type of roof, would the height be lower?
- Why can't you dig lower for building?
- How high above the house is the roofline is the roofline of the garage?
- If another roofline design is used, wouldn't there would be almost no difference between the two rooflines?
- Since the code requires to measure buildings from finished grade of building to highest point, why isn't topography taken into account due to the uniqueness of the lot?
Chair Dankwerth opened the public hearing.
Jim Howard, Oro Valley resident who lives two homes west of property, spoke in opposition of Item 2:
- He bought his home seven years ago for the mountain views. The owners of 720 W. Linda Vista Blvd previously parked an RV in the same location which impacted his views. He is concerned that the height of this garage is to accommodate an RV to be parked inside. This will greatly impact his views. He would like to see the garage of a more standard height.
Chair Dankwerth closed the public hearing.
MOTION: A motion was made by Member Roach and seconded by Member Schoeppach to deny a variance to allow a detached garage closer to the front lot line than the main house, based on the finding that the five criteria have not been met.
MOTION carried, 5-0.
Chair Dankwerth adjourned the meeting at 3:32 p.m.
