Key issues raised by the Board and addressed by staff:
- Would it make sense to change the rules to consider twenty feet from the fill line instead of the natural line?
The owner of the property, Mark Backman, stated this lot is where he would like to build his retirement home and it is well within standards of the homeowner association.
Michael Whyde of Pepper Viner Homes stated they have built three communities in Oro Valley and have worked with Town staff many times.

MOTION: A motion was made by Vice Chair Roach and seconded by Member Schoeppach to approve OV1702648 a variance to increase the building height from 20' to 26', based on the finding that the five criteria have ben met.
Chair Dankwerth asked what the directions are of the homes around this property and asked for further explanation of the wall that was spoken about.
MOTION carried, 5-0.
