Vice Chair Caswell called the meeting to order at 6:00 p.m.

OV12-04-30S, Laskin & Associates, on behalf of Red Lobster Restaurant, requests approval of a landscape plan for an approved building pad within the Oro Valley Marketplace located at the southwest intersection of Oracle and Tangerine Roads. Member Buette stated he did not have Exhibit A.  Karen Berchtold, OV Senior Planner read the conditions. 
 
MOTION: A motion was made by Member Shelton and seconded by Member Buette to approve OV12-04-30S, Laskin & Associates, on behalf of Red Lobster Restaurant, requests approval of a landscape plan for an approved building pad within the Oro Valley Marketplace located at the southwest intersection of Oracle and Tangerine Roads with the conditions in Exhibit A.

Member Schoeppach noted a typographical error.  The words "to approve" appear twice on item 5.
 
MOTION: A motion was made by Member Schoeppach and seconded by Member Shelton to approve the minutes of the June 10, 2008, Development Review Board.

1.

OV3-08-05, Royal Dutch Shell and Giant Industries, represented by Palo Verde Signs, requests approval to place 2 freestanding signs for an existing gas station located at 10505 N. Oracle Road. Kimberly Dannettel, of Palo Verde Signs, non resident, reviewed the proposal.

Bayer Vella, Principal Planner, stated the sign committee approved the proposal.
 
MOTION: A motion was made by Member Buette and seconded by Member Shelton to approve OV3-08-05, Royal Dutch Shell and Giant Industries, represented by Palo Verde Signs, requests approval to place 2 freestanding signs for an existing gas station located at 10505 N. Oracle Road.

2.

OV12-06-24A, Coronado Engineering representing Huw and Cynthia Jones, requests approval of a preliminary plat and landscape plan for Estates at Lambert Lane. The property is zoned R1-144 and is located north of W. Lambert Lane between Shannon Road and La Cholla Boulevard. The project would create two lots from an existing 6.67 acre parcel to be accessed by a private road. Parcel # 224-22-008A. MOTION: A motion was made by Member Buette and seconded by Member Schoeppach to approve to approve OV12-06-24A, Coronado Engineering representing Huw and Cynthia Jones, requests approval of a preliminary plat and landscape plan for Estates at Lambert Lane. Walter Hogue of Rio Linda Vista introduced the consulting team Tri Miller, Karen Cesare and Carlos DeAlva.
Mr. Miller and Ms. Cesare reviewed the following:
Location
Site plan
Layout
Grading Concept
Cross sections
Drainage concept
 
Mr. Houge stated the developer would like to phase in the project and the bufferyards and create a bufferyard from Villa Balboa.
 
Karen Cesare of Novak Environmental reviewed the proposed Landscape Plan.
 
Carlos DeAlva of Sakellar and Associates reviewed the development plan, elevations and materials.

Matt Michels, OV Senior Planner, presented the staff report.

Michael Spaeth, OV Planning Intern, presented the staff report regarding architecture. Mr. Spaeth stated staff recommended approval with the conditions in Exhibit A.

Paul Keesler, OV Development Review Manager, stated a letter from ADOT will be required to allow the developer the option of not building the bus pullout. The pullout was a rezoning condition and at this point in the process should remain a condition. 
 
Call to the audience opened by Vice-Chair Caswell.

Richard Strang, OV resident and President of the Villa Balboa Board of Directors spoke in support of the proposal.

John Scheuring, OV resident, stated he would like to meet with the landscaper regarding plant mitigation.

Bill Adler, OV resident, opined the proposal does not fit the zoning code.

Don Borham, OV resident, asked what the existing elevation and the finished elevation of the proposal would be.
 
Richard Benetar, OV resident said if the developer would be removing all the vegetation without building anything, there would be alot of noise for the residents of Villa Balboa.  If this is the case, does the developer have any noise abatement in their plan?

Matt Michels, OV Senior Planner, addressed the comments and questions. 
-the proposed uses are allowed per code
-landscaping as proposed, 3-1 mitigation, follows code
-water harvesting and it’s extent are not defined in the code
-elevations range from 5 feet higher to meeting grade

Karen Ceasar, Novak Environmental, stated the developer is willing to work with the community and the neighbors to mitigate over planting.

Mr. Hogue stated the plan is to be sensitive to the surrounding area and paving will be done at the time of sales or leases. 

John Scheuring, OV resident, stated his concern regarding drainage.
Tri Miller responded that a flood wall will be constructed.
 
MOTION: A motion was made by Member Shelton and seconded by Member Schoeppach to approve OV12-06-25, applicant's request for a master development plan for Oracle Vista Centre with the conditions in Exhibit A.

*4.  OV13-08-06, rio Linda Vista, represented by Sakellar Associates Architects & Planners, request approval of architecture for the Oracle Vista Centre, located on the northwestern corner of Oracle Road and Linda Vista Boulevard,  The parcel number is 224-31-0110.  The applicant proposes senenteed (17) 5,000-6,000 square foot office buildings wiht on 15,000 square foot restaurant/retail building with a total of 109,000 square feet on a 14-acre site.  If you have any questions regarding this submittal please contact Matt Michels, Senior Planner, (520) 229-4822 or mmichels@orovalleyaz.gov.
 
MOTION: A motion was made by Member Schoeppach and seconded by Member Buette to approve OV13-08-06 applicant's request for approval of architectural elevations for the Oracle Vista Centre upon satisfaction of the conditions in Exhibit A.

Vice-Chair Caswell is now part of the Arizona Planning Southern Section Citizen Planner.  

Member Buette requested future agenda item to appoint a new sign committee member. 
 
*6.  Planning and Zoning Update.  Staff will update the Board on relevant issues.  No discussion of such items is enabled and must be appropriately placed on an agenda for a future meeting.
 
Karen Berchtold, OV Senior Planner gave an update of upcoming meetings regarding the general plan.
