Martin Krawitz, Larsen Baker, non resident, presented the proposed development plan for Palisades of Oro Valley. Mr. Krawitz stated the developer met with the neighbors and further discussed the grading waiver and landscape. Mr. Krawitz reviewed the following:

Mr. Krawitz stated the developer concurred with the conditions in the staff report.
John Evans, non resident, of Larsen Baker, reviewed the proposed development plan.
Mr. Zinkin stated he had been contacted by neighbors and was told that during one of the meetings between neighbors and the developer, a commitment was made that lights would not be any higher than 10 feet. Mr. Krawitz stated the developer has committed to shield light from the neighbors but no specific height was discussed.
Larry McGlone, non resident, stated the lighting in question at the east property line, exterior lighting between the buildings and the property line, will not exceed 10 feet.
Jeff Covine, Landscape Architect and non resident, reviewed the proposed landscape and reviewed the following:

David Ronquillo, OV Senior Planner, presented the staff report and reviewed the following:

Parking analysis
Mr. Ronquillo stated staff’s concern regarding the mixed use of the project; staff would like to see less restaurant or more office use. Staff requested the applicant submit a traffic analysis by a professional traffic engineer. Staff would recommend approval of the development plan with the exclusion of the parking analysis.
Mr. Ronquillo presented the landscape plan. Mr. Ronquillo stated all of the off sets along the wall located at the western edge of the buffer need to be eliminated. Mr. Ronquillo stated staff recommended approval with the conditions in Exhibit A.
Mr. McGlone discussed the parking analysis that he provided. Mr. McGlone explained that assumptions had to be made because all of the tenants have not been identified. The analysis uses the worst case scenario.
Martin Krawitz reminded DRB that the development is deed restricted to night time only restaurants at the east buildings.
John Evans stated the presentation showed a worst case scenario; the parking spaces needed is speculation. The thought was to have more parking than needed so as not to be under parked.
Jennifer Gillaspie, Oro Valley resident, wanted to confirm the requirements made by Town Council were incorporated in the development for approval. Ms. Gillaspie requested that the lighting be restricted to 10 feet within 130 feet and the hours of operation limited to no later than 11 p.m. Ms. Gillaspie also asked if the standards for scrubbing the restaurant smoke stacks were Pima County standards or Oro Valley. She also wanted to ensure adequate bonding was required in case the development was not completed.
Elen Zank, Oro Valley resident, stated the developers have been very kind in discussing the proposal. Ms. Zank stated she would be happier with anything other than a restaurant and requested that she be present when trees are being placed. Ms. Zank asked if the buildings are changed from restaurant to retail, that the HVAC be put on the ground.
Mr. Krawitz stated he has committed to be with the neighbors when any additional trees are placed. They also would commit to looking at converting about 2200 square feet from restaurant to retail space, to meet the parking requirements. Mr. Krawitz stated the developer would be willing to hire a private third party traffic engineer to produce a parking analysis.
Bayer Vella, OV Principal Planner, suggested utilizing a condition that the applicant work with staff to either achieve complete compliance with OVZCR parking requirements or develop an alternative parking analysis to staff's satisfaction, that will be reviewed and approved by Town Council

Mrs. Pelletier stated the proposal meets code and staff recommended approval with the conditions in Exhibits A for both the Retreats at Vistoso and the Courtyards at Vistoso.
Joe Hornat, Oro Valley resident, stated his concern for two story buildings on 45 foot lots and the walls that will be along Rancho Vistoso Boulevard. Mr. Hornat requested the buildings be restricted to single story.
Mrs. Pelletier continued and reviewed the surrounding area comparison.
Staff recommended approval of the Courtyards with the conditions in Exhibit A.
