Lorne Brown, OV resident, and Rick Herrington, non resident, of Herrington Architectural Designers and Planners presented the proposal. Mr. Brown stated he would like to build a Recreational Vehicle (RV) garage and seeks an exception to the grading permit because it will exceed 8 feet.
Member Ottley asked if the structure would be seen by neighbors. Mr. Brown acknowledged that the majority of the residents can look out and see the structure.
Paul Keesler, OV Development Review Manager, presented the staff report and reviewed the following:

Member Wowk asked if the house to the rear of the house in question was above or below the proposed RV garage. Mr. Keesler responded that the house in the rear is below the proposed RV garage. Member Wowk asked if that neighbor is staring at a ridge and asked how high the ridge is compared to the house. Mr. Keesler did not have the information.
Member Anderson wanted to confirm that the RV garage would not be any higher than the house. Mr. Brown stated the top of the RV garage would not exceed the height of the primary residence and would be capped at 18 feet.
Member Luckett asked if the parapet of the garage would be about 7-9 feet above the east property line and if that neighbor to the east would be looking at 7-9 feet of the garage.
Mr. Brown responded that the neighbor to the east is 45 feet below the floor of their house. Member Luckett corrected himself stating he was concerned about the property to the west.
Lottie Darby, OV Resident, asked why the Homeowner’s Association (HOA) was now allowing RV garages.
Dan Evans, OV Resident, stated he liked the idea that the applicant is grading to minimize the impact to the rest of the neighbors.
Bill Adler, OV resident, stated that the best time to review a grading exception is when the land is vacant. The rules of the Oro Valley Zoning Code Revised (OVZCR) are meant to preserve not to destroy. Mr. Adler stated that holding the topography responsible is not right. Now that the residence is built, it is the residence that is creating the difficulty.
MOTION: A motion was made by Member Ottley and seconded by Member Shelton to approve to approve OV13-09-10, Lorne E. Brown requests approval of a grading exception on Lot 84 of Monte Del Oro to accommodate an RV garage, storage, and outdoor kitchen, located at 11025 N. Guava Drive.
MOTION carried, 6-0
Member Ottley stated the HOA has reviewed the project in detail and has approved the proposal. The applicant has mitigated as much as they can.

OV12-08-09, La Cholla Tangerine, LLC, represented by Coronado Engineering and Development, Inc., requests approval of a preliminary plat and landscape plan for the “Rancho Del Cobre” subdivision, located on the southeast corner of Tangerine Road and La Cholla Boulevard.

Member Wowk asked if only the east side of the project would be single story. Mr. Nzomo responded it is unknown at this time but 18 feet is the limit of the roof.
Matt Michels, OV Senior Planner, presented the staff report and reviewed the following:

Staff recommended approval of the Preliminary Plat and Landscape Plan subject to the conditions in Exhibit A.
Allen Lathrem, OV resident, stated his concern about the State of Arizona proposing 8 lanes of freeway where Tangerine Road is now and people may lose there homes because Oro Valley is not requiring enough setback.
Patricia Vega, OV resident, stated her concern about the wash and drainage. Ms. Vega asked if the wash had the capacity to handle the flow and inquired about public access to the development. Ms. Vega questioned if the wash is going to be deeded to the public or to the HOA.
Tony Turco, OV resident, questioned how Ironwood Canyon would line up or if there would be lights shining into houses. Mr. Turco stated he was concerned with the traffic on Glover because of the children in the neighborhood. Mr. Turco questioned why the larger lots being located to the south rather than the east and asked if a builder had been identified. Mr. Turco is in favor of the plan.
Paul Keesler stated the developer would be placing detention basins that would reduce the wash water flow.
Mr. Nzomo stated there has been no builder identified as of yet.
Paul Keesler stated that through the rezoning, the street connectivity between the main street and the subdivision was not connected. Mr. Keesler stated that staff is cognizant of the plans that ADOT has to widen Tangerine Road. There is a possibility in the future to provide connectivity to the neighborhood. The traffic generated from this development is not very high; 300 to 400 cars per day.
Mr. Nzomo stated the washes are deeded to the HOA’s and Tangerine Road calls for 300 feet of right of way and roads are offset from the other neighborhoods.
