CALL TO ORDER
The meeting was called to order at 2:01 p.m.

CALL TO AUDIENCE - There were no speaker requests.
             
Notice of Possible Executive Session
Pursuant to ARS § 38-431.03 (A)(2)(3), the Board may vote to convene in executive session to discuss or consider confidential records exempt by law from public inspection, and/or to consult with the Board's attorney for legal advice and to consider the Board's position and to instruct the Board's attorney regarding its position in contemplated litigation regarding Agenda Items 2-5. The Board will take action on these items in open session.
             
REGULAR SESSION AGENDA
             
   1. REVIEW AND APPROVAL OF THE JULY 18, 2023 REGULAR SESSION MEETING MINUTES
  Members reviewed the minutes as written with no discusion.
             
  Motion by Member Carmen Trevizo, seconded by Member Katherine Beck to approve the July 18. 2023 regular session minutes.

  Vote: 5 - 0 Carried
             
   2. NEW MEMBERSHIP APPROVAL AND REVIEW FOR POSSIBLE PRE-EXISTING CONDITIONS FOR NEW OFFICER JOSHUA LEINART, HIRE DATE AUGUST 21, 2023, TIER 3 DATE NOVEMBER 19, 2023
             
  Motion by Chairman David Gephart, seconded by Member Carmen Trevizo to find that Joshua Leinart meets all applicable PSPRS membership definitions, including the definition of Member, A.R.S. § 38-842 (31), and all its related definitions, and regular assignment to hazardous duty, pursuant to A.R.S. § 38-842 (42), effective on the date of his hire, August 21, 2023, with a Tier 3 date of November 19, 2023 AND to declare the Board's finding of one (1) pre-existing condition as noted in the medical examination report.

  Vote: 5 - 0 Carried
             
   3. NEW MEMBERSHIP APPROVAL AND REVIEW FOR POSSIBLE PRE-EXISTING CONDITIONS FOR NEW OFFICER MATTHEW CARTER, HIRE DATE SEPTEMBER 11, 2023, TIER 3 DATE DECEMBER 10, 2023
             
  Motion by Member Katherine Beck, seconded by Member Roger Reynolds to find that Matthew Carter meets all applicable PSPRS membership definitions, including the definition of Member, A.R.S. § 38-842 (31), and all its related definitions, and regular assignment to hazardous duty, pursuant to A.R.S. § 38-842 (42), effective on the date of his hire, September 11, 2023 with a Tier 3 date of December 10, 2023 AND to declare the Board's finding of five (5) pre-existing conditions as noted in the medical examination report.

  Vote: 5 - 0 Carried
             
   4. NEW MEMBERSHIP APPROVAL AND REVIEW FOR POSSIBLE PRE-EXISTING CONDITIONS FOR NEW OFFICER DAVID LARSON, HIRE DATE SEPTEMBER 11, 2023, TIER 3 DATE DECEMBER 10, 2023
             
  Motion by Member Carmen Trevizo, seconded by Member Katherine Beck to find that David Larson meets all applicable PSPRS membership definitions, including the definition of Member, A.R.S. § 38-842 (31), and all its related definitions, and regular assignment to hazardous duty, pursuant to A.R.S. § 38-842 (42), effective on the date of his hire, September 11, 2023, with a Tier 3 date of December 10, 2023 AND to decalre the Board's finding of three (3) pre-existing conditions, as noted in the medical examination report.

  Vote: 5 - 0 Carried
             
   5. NEW MEMBERSHIP APPROVAL AND REVIEW FOR POSSIBLE PRE-EXISTING CONDITIONS FOR LATERAL TRANSFER OFFICER MARCOS GARCIA WITH A HIRE DATE OF OCTOBER 30, 2023
  The Board discussed that since Officer Garcia is a lateral transfer officer whose original PSPRS membership date was April 24, 2022, any pre-existing conditions noted in the medical examination report after that date do not need to be declared.
             
  Motion by Chairman David Gephart, seconded by Member Carmen Trevizo to find that Marcos Garcia meets all applicable PSPRS membership definitions, including the definition of Member, A.R.S. § 38-842 (31), and all its related definitions, and regular assignment to hazardous duty, pursuant to A.R.S. § 38-842 (42), effective on the date of his hire, October 30, 2023 AND to declare the Board's finding of no (0) pre-existing conditions as noted in the medical examination report.

  Vote: 5 - 0 Carried
             
   6. REVIEW AND APPROVAL OF RESIGNATIONS AND RETIREMENTS OF THE FOLLOWING MEMBERS, THUS TERMINATING THEIR MEMBERSHIPS: JACOB TAYLOR RESIGNATION EFFECTIVE AUGUST 24, 2023, FELIX OLIVAS RESIGNATION EFFECTIVE AUGUST 31, 2023, AARON LESUER RETIREMENT EFFECTIVE SEPTEMBER 28, 2023
             
  Motion by Member Carmen Trevizo, seconded by Member Roger Reynolds to approve the resignations and to terminate the memberships of Jacob Taylor and Felix Olivas, AND to approve the retirement and terminate the membership of Aaron LeSuer.

  Vote: 5 - 0 Carried

  Motion by Member Carmen Trevizo, seconded by Member Katherine Beck to adjourn the meeting at 2:21 p.m.
