CALL TO ORDER AT OR AFTER 6:00 PM

Chairman Swope called the meeting to order at 6:01 PM.

Chairman Swope led the audience in the Pledge of Allegiance.

CALL TO AUDIENCE - AT THIS TIME, ANY MEMBER OF THE PUBLIC IS ALLOWED TO ADDRESS THE COMMISSION ON ANY ISSUE NOT LISTED ON TODAY’S AGENDA.  PURSUANT TO THE ARIZONA OPEN MEETING LAW, INDIVIDUAL COMMISSION MEMBERS MAY ASK TOWN STAFF TO REVIEW THE MATTER, ASK THAT THE MATTER BE PLACED ON A FUTURE AGENDA, OR RESPOND TO CRITICISM MADE BY SPEAKERS.  HOWEVER, THE COMMISSION MAY NOT DISCUSS OR TAKE LEGAL ACTION ON MATTERS RAISED DURING "CALL TO AUDIENCE."  IN ORDER TO SPEAK DURING "CALL TO AUDIENCE" PLEASE SPECIFY WHAT YOU WISH TO DISCUSS WHEN COMPLETING THE BLUE SPEAKER CARD.

COUNCIL LIAISON COMMENTS

Councilmember Hornat commented on the following, Town Council will be hearing the General Plan Amendments on December 11th, vacant Planning and Zoning Commission member interviews, impact fees will be heard by Town Council on December 4th.  Councilmember Hornat thanked the Commission for their hard work.

MOTION: A motion was made by Vice Chair Cox and seconded by Commissioner Leedy to Approve the October 15, 2013 Special Session and November 7, 2013 Special Session meeting minutes.

MOTION carried, 5-0.

Paul Oland, WLB, representing the property owner presented the following:

Chairman Swope opened the Public Hearing.

Erica Wiese, Oro Valley Resident, commented that cut through traffic is very dangerous and a big concern.  Ms. Wiese is concerned with the amount of traffic and asked why there wasn't a connection to existing neighborhoods.

Art Wiese, Oro Valley Resident, commented that the views of the Catalina Mountains with two-story homes is a concern. 

Bill Adler, Oro Valley Resident, commented that he is opposed to using similarity of adjacent developments as a criteria to determine the acceptance of a new proposal.  There has been increased difficultly with variances on smaller lots and larger homes which seems to be the market demand.  There should be a careful review of market demand for larger homes on smaller lots. 

Chairman Swope closed the Public Hearing.

Paul Oland, commented on the questions asked during the Public Hearing, including connecting to existing neighborhoods.

MOTION: A motion was made by Commissioner Caine and seconded by Commissioner Rodman to Recomend Approval of the PAD Amendment for Parcel 10T, Rancho Vistoso from Commercial (C-1) to Medium Density Residential (MDR), based on the finding that the request complies with the Rancho Vistoso Planned Area Development and the General Plan, subject to the conditions in Attachment 1.

Planning:

 1.  The remainder .78 acres along the east boundary of the subject property shall be permanently designated as open space in accordance with the Environmentally Sensitive Lands requirements on the subdivision plat.

 2.  Potential cut-through traffic will be evaluated by a professional engineerTraffic  calming  measures  may  be  required  to  be  installed  by  the developer, if determined necessary by the Town Engineer.

 3. A trail connection shall be constructed between the existing trail in the northeast corner of the property and the proposed internal sidewalk.

Chairman Swope opened the public hearing.

Dick Eggerding, Oro Valley resident, spoke on the history of public art within Oro Valley Hospital.  Mr. Eggerding commented that there are 3 component parts to making public art a success; the developer/applicant, staff and the artist. Without the cooperation of all 3 components, you don't have anything. 

John Musoff, Oro Valley resident, stated that there are about 250 to 300 public art pieces located within Oro Valley.  Mr. Musoff went on to comment on the expansion of public art forms and the involvement of the Southern Arizona Arts and Cultural Alliance (SAACA) organization in the call for artist's process.

Don Bristow, Oro Valley resident, commented that the proposal tonight fails to advance the concept of arts and culture.  Developers and business owners should have the opportunity to fund other forms of art and culture.  This amendment does not support the purposes stated within the Public Art Provisions.  Therefore, this Commission should recommend to the Council the following:  to not proceed with the public art code amendment as it is to limiting in its definition of public art, conduct an updated cultural assessment to determine the citizens desires and prepare a new public art ordinance.

Kelly Huber, Non-Oro Valley resident, commented that Town has put a lot of thought and effort into this amendment, it is directly in line with what is happening in many other communities.  The Call for Artists Process is a strength to attract the best artist and best art here to Oro Valley. The use of a qualified agent is going to standardize how the developers are choosing the artist. It's amazing to see what Oro Valley has done and with these changes it is only going to strengthen Oro Valley as a leader in public art. 

Bill Adler, Oro Valley resident, commented that his concern was the diversification of the nature of art.  There are no guidelines to judge the quality or qualifications of an artist.  If the scope of art work is expanded to include other forms of art, that will expand the variety of artists that apply.  Mr. Adler believes that the Town should only judge the location and whether it is clearly visible.  Mr. Adler would rather see the ordinance left alone than adoption of the proposed changes.

Chairman Swope closed the public hearing.

Chad Daines, Principal Planner, commented on the questions asked during the public hearing including consideration of all mediums, qualified agents, the repetitive nature of art pieces, the selection panel and review of public art.

Discussion ensued amongst the Commission regarding diversity in art and the proposed requirements.

MOTION: A motion was made by Commissioner Drazazgowski and seconded by Vice Chair Cox to Recomend Approval of the proposed amendments to the Zoning Code as provided in Attachment 1, based on a finding that the amendment enhances the quality of public art through the addition of a Call For Artists process and updated Conceptual Design Review Principles, subject to a change in Section 27.3.E.2 changing $2,000,000 to $4,000,000.

Commissioner Leedy offered a friendly amendment to make a change in Section 27.3.E.1 from $2,000,000 to $4,000,000 and add the words "at least" before "regionally advertised". The friendly amendment was accepted by Commissioner Drazazgowski and the Vice Chair Cox.

MOTION carried, 6-0.
 
Chairman Swope recessed the meeting at 7:34 PM.  The meeting resumed at 7:38 PM.

Bayer Vella, Conservation and Sustainability Administrator, provided an overview of the Your Voice project including a summary of the phone survey results, comparison of 2013 responses with 2002 responses and received input from the Commission on three questions related to the project.
