CALL TO ORDER

Chair Hurt called the meeting to order at 6:00 p.m.

PLEDGE OF ALLEGIANCE

Chair Hurt led the Commission and the audience in the Pledge of Allegiance.

CALL TO AUDIENCE - at this time, any member of the public is allowed to address the Commission on any issue not listed on today’s agenda. Pursuant to the Arizona open meeting law, individual Commission members may ask Town staff to review the matter, ask that the matter be placed on a future agenda, or respond to criticism made by speakers. However, the Commission may not discuss or take legal action on matters raised during "Call to Audience." In order to speak during "Call to Audience", please specify what you wish to discuss when completing the blue speaker card.

There were no speaker requests.

COUNCIL LIAISON COMMENTS

Council Liaison Bill Rodman provided the following updates:

- The Council acted in concert with the Commission on three of the four General Plan Amendments and approved (the fourth was continued).
- There is a joint Study Session next week with the Town Council and Town of Marana.
- There is a Council Study Session on January 17 on Economic Development.
- The referendum to reverse the approvals on the General Plan Amendments did not go through.

REVIEW AND APPROVAL OF THE DECEMBER 5, 2017 REGULAR SESSION MEETING MINUTES


12/5/2017 Draft Minutes

MOTION: A motion was made by Commissioner Cox and seconded by Commissioner Hitt to approve the December 5, 2017 regular session meeting minutes as written.

Commissioner Swope stated that he feels the reason(s) should be reflected in the minutes whenever a Commissioner votes against an issue.

MOTION carried, 6-0.
 
2.

ELECTION OF CHAIR FOR THE PLANNING AND ZONING COMMISSION EFFECTIVE JANUARY 10, 2018


MOTION: A motion was made by Vice Chair Barrett and seconded by Commissioner Gribb to nominate Chair Hurt to continue to serve as the Chair for the Commission.

Chair Hurt declared himself as Chair.

3.

ELECTION OF VICE CHAIR FOR THE PLANNING AND ZONING COMMISSION EFFECTIVE JANUARY 10, 2018


MOTION: A motion was made by Commissioner Swope and seconded by Commissioner Gribb to nominate Vice Chair Barrett to continue to serve as Vice Chair for the Commission.

Chair Hurt declared Ms. Barrett as Vice Chair.

PUBLIC HEARING: DISCUSSION AND POSSIBLE ACTION ON A ZONING CODE TEXT AMENDMENT TO SECTION 22.3.L, REGARDING THE SUBMITTAL REQUIREMENTS, PROTEST AREA AND IMPACT OF WRITTEN PROTESTS BY PROPERTY OWNERS FOR REZONING CASES (OV1703070).

Planner Milini Simms gave a presentation that included the following:

- Purpose
- Background
- Previous Arizona state law
- New Arizona State Law
- Summary and Recommendation

Chair Hurt opened the public hearing.

There were no speaker requests.

Chair Hurt closed the public hearing.

MOTION: A motion was made by Commissioner Cox and seconded by Commissioner Hitt to recommend approval of the Zoning Code Amendment (Attachment 1) to Section 22.3.L., related to written protests by property owners, based on the finding it is in conformance with Arizona State Law.

Commissioner Cox asked if the amendment change meets the requirements of the state law. Chief Civil Deputy Attorney Joe Andrews responded it is verbatim of the state law.

Vice Chair Barrett commented that she did not like that written protests are almost impossible, but will vote in favor since it is state law, with Commissioners Gribb and Swope concurring.

MOTION carried, 6-0.
 
5.

PUBLIC HEARING:  DISCUSSION AND POSSIBLE ACTION ON A ZONING CODE AMENDMENT RELATED TO SMALL CELL WIRELESS FACILITIES (OV1702913)


Attachment 1 Draft Code Amendment Small Cell Wireless

Planning Manager Bayer Vella gave a presentation that included the following:

- Purpose
- Small Cell Wireless
- New Arizona State Law
- Summary & Recommendation

Commissioner Gribb asked why we don't wait for the ordinance pass first and then change the zoning code? Mr. Vella responded they are being done in tandem.

Chair Hurt opened the public hearing.

There were no speaker requests.

Chair Hurt closed the public hearing.

MOTION: A motion was made by Commissioner Hitt and seconded by Vice Chair Barrett to recommend approval of the Zoning Code Amendment in Attachment 1 related to small cell wireless facilities, based on the finding that the State requires the Town to exempt them from the zoning code.

MOTION carried, 6-0.
 
PLANNING UPDATE (INFORMATIONAL ONLY)

Planning Manager Bayer Vella presented the Planning Update:

- Update on the Tucson Electric Power subcommittee that includes two (2) Commission members.
- Next Planning and Zoning Commission meeting is February 6, 2018.
- Town Council Study Session on Economic Development at 4:00 p.m. on January 17, 2018; the Regular Session following at 6:00 p.m. will have three (3) Planning items.
- Brief information on the four (4) upcoming neighborhood meetings.

ADJOURNMENT

Chair Hurt adjourned the meeting at 6:22 p.m.
