CALL TO ORDER

Chair Cuffari called the meeting to order at 4:01 p.m.

  The Stormwater Utility Commission Meeting was held electronically via Zoom.  Commissioner Hawkinson attended by telephone.
             
CALL TO AUDIENCE

Chair Cuffari provided instructions regarding conduct and participation in the meeting.

Oro Valley resident Jim Coffey asked staff to consider responding to the Naranja Trails proposed development at an upcoming meeting.
             
COUNCIL LIAISON COMMENTS (INFORMATIONAL ONLY)

Council Liaison Bill Rodman provided updates from the recent Town Council meeting.
             
DIRECTORS REPORT (INFORMATIONAL ONLY)

Division Manager John Spiker reported on the following subjects:
  • Updates and overhauls to the Drainage Criteria Manual which was last modified in 2010
  • Arizona Construction General Permit was updated by ADEQ, we have been communicating with the Construction community to try to stay in compliance
  • A change to the Waters of the United States Rule by the EPA and the Army Corps of Engineers, that affects federally regulated water courses
  • The State ADEQ is looking at a Waters of Arizona to supplement the outgoing Waters of the US change
  • Responses to post fire flooding issues, we've had some of our best outreach efforts taking place at this time
  • Recognition and thanks to Stormwater Utility staff team regarding: GIS Mapping application, Sandbag Program, Monsoon Preparedness, Floodplain Information Requests, Invoicing and Updating the Stormwater webpage
             
REGULAR SESSION AGENDA
             
   1. REVIEW AND APPROVAL OF THE JULY 16, 2020 MEETING MINUTES
             
  Motion by Commissioner Richard Hawkinson, seconded by Commissioner Jack Stinnett to approve the July 16, 2020 regular session minutes as written.

  Vote: 4 - 0 Carried
             
   2. RECOGNITION OF OUTGOING STORMWATER UTILITY COMMISSION COUNCIL LIAISON BILL RODMAN
  On behalf of the Stormwater Utility Commission, Mr. Spiker recognized Councilmember Rodman's service to the Town and thanked him for all his efforts. 
             
   3. DISCUSSION OF MEETINGS AND EVENTS
  Mr. Spiker reported on recent meetings and events. 
             
   4. DISCUSSION OF BIGHORN FIRE AND IMPACTS
  Mr. Spiker reported that the Bighorn Fire was out. Lack of rain allowed Oro Valley and its partners to prepare and coordinate responses should they be needed. There is continued monitoring of the burn scar area and will be ongoing for the next couple of years to assess soil conditions and flooding potential. We are in a holding and monitoring pattern for right now. 
             
   5. DISCUSSION OF ANNUAL STORMWATER UTILITY RATE ANALYSIS AND APPROVAL OF A NO RATE ADJUSTMENT SCENARIO RECOMMENDATION TO MAYOR AND COUNCIL
  Assistant Director/Public Works Aimee Ramsey presented a report on the Stormwater Utility Rate Analysis. Discussion ensued between the Commission and staff. 
             
  Motion by Vice Chair Joan Brown, seconded by Commissioner Richard Hawkinson to approve the status quo base rate for the Stormwater Utility for 2020/2021. 

A roll call vote was taken:

  Vote: 4 - 0 Carried
  The fiscal year date is on the Agenda for the November 19, 2020 meeting to be corrected to reflect FY 21-22 instead of FY 20-21.
             
   6. DISCUSSION OF ARIZONA DEPARTMENT OF WATER RESOURCES (ADWR) COMMUNITY ASSISTANCE VISIT AUDIT
  Senior Engineer Justin Turner reported on the audit by the Arizona Department of Water Resources (ADWR) which is done once every 5 (five) years. The purpose is to see if we are administering the Floodplain Management Program in compliance with federal regulations that require our community to make sure that new land developments are substantially safe from flooding. Staff was pleased with the outcome of the audit and confident in our ability to maintain our Floodplain Management Program. 
             
   7. DISCUSSION OF TOWN OF ORO VALLEY'S 2020 MS4 ANNUAL REPORT AND DISCHARGE MONITORING REPORT
  Mr. Spiker reported that the Towns 2019/2020 MS4 Annual Report due to ADEQ by September 30, 2020 shows our program to be in compliance. Mr. Spiker encouraged the Commissioners to review the draft report and to provide any feedback by September 25, 2020.

Discussion ensued between the Commissioners and staff. The Commissioners commented that it looked to be a job well done.
             
   8. DISCUSSION OF CANCELLATION OF THE OCTOBER 2020 STORMWATER UTILITY COMMISSION FIELD TRIP
  Mr. Spiker reported that this years field trip has been cancelled due to the Covid-19 restrictions and the bringing on of a new Council Liaison and possible new Commissioners in the near future. We will arrange for a field trip in the Spring of 2021.
             
   9. DISCUSSION OF CARMACK WASH REMAPPING
  Mr. Turner reported on the remapping of the Carmack Wash by the Pima County Flood Control District.
             
   10. DISCUSSION OF HIGHLAND WASH FLOOD MITIGATION PROJECT
  Mr. Turner reported on the  Highland Wash Flood Mitigation Project.   

Mr. Spiker spoke on the collaborative efforts between the Town and the Pima County Flood Control District.
             
   11. DISCUSSION AND POSSIBLE ACTION REGARDING THE CANCELLATION OF THE OCTOBER 15, 2020 SWUC REGULAR SESSION MEETING
             
  Motion by Commissioner Richard Hawkinson, seconded by Commissioner Jack Stinnett to approve cancellation of the October 15, 2020 regular session meeting.

A roll call vote was taken:
