CALL TO ORDER
  Mayor Winfield called the meeting to order at 6:00 p.m.

PLEDGE OF ALLEGIANCE
  Councilmember Piña led the audience in the Pledge of Allegiance. 
             
SWEARING IN OF NEWLY ELECTED COUNCILMEMBERS WITH TERMS EFFECTIVE NOVEMBER 4, 2020 THROUGH NOVEMBER 6, 2024
  Town Clerk Mike Standish swore in Councilmember Steve Solomon, Harry Greene, and Tim Bohen with terms effective November 4th, 2020 to November 6, 2024.
             
SEATING OF NEWLY ELECTED COUNCILMEMBERS AND REMARKS BY THE NEWLY ELECTED COUNCILMEMBERS
  Councilmembers Solomon, Greene and Bohen expressed their appreciation and thanked residents for their support with their election to office. 
             
UPCOMING MEETING ANNOUNCEMENTS
  Town Clerk Mike Standish announced the upcoming Town meetings.
             
COUNCIL REPORTS
  Councilmember Solomon recognized Lyra Done with a tribute to her life.

Councilmember Jones-Ivey reported the Southern Arizona Network for Down Syndrome would hold their 20th Anniversary Tucson BuddyWalk on November 15, 2020 and encouraged citizens to participate. 

Councilmember Nicolson expressed his gratitude for the opportunity to have known Lyra Done.

Mayor Winfield thanked Paul Keesler for organizing, and citizens that participated in a litter clean up day as part of the National Make a Difference Day. Mayor Winfield also encouraged citizens to get their flu shots.
             
TOWN MANAGER'S REPORT
  Town Manager Mary Jacobs reported the following information:
 
  • Welcomed the newly elected coucilmembers, Steve Solomon, Tim Bohen and Harry Greene. 
  • Over 100 Oro Valley businesses had been approved to receive assistance as part of the OVsafesteps program.
  • Ms. Jacobs thanked the Greater Oro Valley Chamber of Commerce for hosting the State of the Town virtual event held on October 28, 2020 and congratulated Mayor Winfield for another successful event. Ms. Jacobs encouraged residents to view the State of the Town video on the Town's website under the Town's Mayor and Council Page. 
  • The Town would be a sponsor in the "Taste of Oro Valley" event held on November 8, 2020. This event would help to boost local restaurants.
             
ORDER OF BUSINESS
  Mayor Winfield reviewed the order of business and stated that the order would stand as posted.

Mayor Winfield provided the guidelines for participation in the Town Council's Regular and Study Session
Zoom meeting.

  Motion by Vice-Mayor Melanie Barrett, seconded by Councilmember Joyce Jones-Ivey to deny the issuance of a Series 7 Liquor License to the Arizona Department of Liquor Licenses and Control for Dung Binh Tran Le for Oro Valley Hand & Foot Spa, located at 12995 N. Oracle Road, Ste #151.

  Discussion continued amongst Council and staff regarding item #1. 
             
  Motion by Vice-Mayor Melanie Barrett, seconded by Councilmember Joyce Jones-Ivey to deny the issuance of a Series 7 Liquor License to the Arizona Department of Liquor Licenses and Control for Dung Binh Tran Le for Oro Valley Hand & Foot Spa, located at 12995 N. Oracle Road, Ste #151.

   2. DISCUSSION AND POSSIBLE ACTION REGARDING PROPOSED TEXT AMENDMENTS TO REGULATE RECREATIONAL MARIJUANA IN RESPONSE TO POTENTIAL VOTER APPROVAL OF PROPOSITION 207

A: RESOLUTION NO. (R)20-53, DECLARING THE PROPOSED TEXT AMENDMENTS TO TOWN CODE, CHAPTER 8, ARTICLE 8-6, AND THE ZONING RELATED TEXT AMENDMENTS TO CHAPTER 23, CHAPTER 25, CHAPTER 31 AND OTHER ASSOCIATED CHAPTERS IN ATTACHMENT 1 AND FILED WITH THE TOWN CLERK, A PUBLIC RECORD

B: PUBLIC HEARING: ORDINANCE NO. (O)20-10, REGARDING TEXT AMENDMENTS TO TOWN CODE, CHAPTER 8, ARTICLE 8-6 AND THE ZONING RELATED TEXT AMENDMENTS TO CHAPTER 23, CHAPTER 25, CHAPTER 31 AND OTHER ASSOCIATED CHAPTERS, AND DECLARING AN EMERGENCY TO EXIST
  Town Manager Mary Jacobs provided an overview of item #2. 
             
  Motion by Mayor Joseph C. Winfield, seconded by Councilmember Steve Solomon to approve Resolution No. (R)20-53, declaring the proposed amendments to the Town Code, Chapter 8-Article 8-6, and the zoning related Chapter 23, Chapter 25, Chapter 31 and other associated sections in Attachment 1 and filed with the Town Clerk, a public record.

  Vote: 9 - 0 Carried
  Oro Valley Principal Planner Milini Simms and Chief Civil Deputy Town Attorney Joseph Andrews presented item #2B and included the following:

  Motion by Vice-Mayor Melanie Barrett, seconded by Councilmember Steve Solomon to approve Ordinance No. (O)20-10, the proposed amendments to the Town Code, Chapter 8, Article 8-6 and the zoning related Chapter 23, Chapter 25, Chapter 31 and other associated sections in Attachment 2 but amending Oro Valley Zoning Code section 25.1.B.19.a.ii.k by changing the hours of operation to reflect 7:00 a.m. to 8:00p.m. and declaring an emergency to exist. 

  Vote: 2 - 0 Carried
  Discussion continued amongst Council and staff regarding item #2B.

   3. DISCUSSION AND POSSIBLE ACTION ON FEES CHARGED TO, AND/OR ASSISTANCE THAT CAN BE PROVIDED TO, SWIM TEAMS THAT UTILIZE THE TOWN AQUATICS FACILITY
  Vice-Mayor Barrett and Councilmember Nicolson provided a brief overview of why item #3 was requested.

Vice-Mayor Barrett summarized information provided from the FAST Swim team. 

Discussion ensued amongst Council and staff regarding item #3.
             
  Motion by Councilmember Joyce Jones-Ivey, seconded by Councilmember Harry Greene request Town staff to speak with Pima County regarding possible Covid safety protocols for the Aquatic center to allow increased lane usage and to view various financial assistance opportunities for swim teams that utilize the Town Aquatics Facility. 

Vice Mayor Barrett requested that the original motion be amended to also include that staff look at the Town's Aquatic Center fees in comparison to other jurisdiction fees. 

             
  Motion by Councilmember Joyce Jones-Ivey, seconded by Councilmember Harry Greene to amend the main motion to request Town staff to speak with Pima County regarding possible Covid safety protocols for the Aquatic center in order to allow increased lane usage, review various financial assistance opportunities for swim teams that utilize the Town Aquatics Facility and to request staff to look at the Town's Aquatic Center fees in comparison to other jurisdiction fees.

  Councilmember Greene thanked staff for hosting a very successful Halloween Spooktackular event held on October 31, 2020.

  Motion by Mayor Joseph C. Winfield, seconded by Vice-Mayor Melanie Barrett to adjourn the Regular Session at 8:47 p.m.

  Oro Valley Planning Manager Bayer Vella gave an overview of Study Session item #1 and introduced Lucinda Smedley representing The Real Estate Consulting Group.
